Terms and Conditions for Medifinder Subscription/Membership

These Terms and Conditions ("Terms") govern your subscription or membership with Medifinder, a helpline service owned by Exmass Health Private Limited ("Medifinder," "we," "us," or "our"). By subscribing to or becoming a member of Medifinder, you ("Customer," "you," or "your") agree to be bound by these Terms. Please read them carefully.

1. Nature of Medifinder Services

• Medifinder provides helpline services only. Our primary function is to suggest suitable hospitals, diagnostic centres, and medical stores based on your requirements, budget, and location.
• Medifinder is NOT a medical service provider, hospital, diagnostic centre, or medical store. We do not provide medical advice, diagnosis, treatment, or emergency services.
• Medifinder is NOT liable for any error, mistake, deficiency, or gap in service provided by any third-party service provider, including but not limited to hospitals, diagnostic centres, and medical stores, that we may suggest. Your engagement with such service providers is directly between you and them, and Medifinder shall not be held responsible for their actions, omissions, or the quality of their services.

2. Customer's Choice and Liability

• While Medifinder will provide suggestions, your choice of service provider is final and entirely at your discretion. You are not bound to follow any advice or suggestion given by Medifinder.
• Medifinder shall not be held liable for your selection of any service provider or for any consequences arising from your decision to engage with them.

3. Service Area Limitations

• Medifinder is currently providing its services exclusively in Lucknow, Uttar Pradesh, India.
• It is your responsibility to read and review the list of our partner hospitals and labs before taking the membership to ensure they cater to your needs within the specified service area. Medifinder will not be liable for services sought outside our operational area or from non-partner entities.

4. Customer Information and Data Sharing

• You agree to provide correct, complete, and updated details in the membership form. Medifinder relies on the accuracy of the information provided by you to offer appropriate suggestions.
• You hereby expressly consent to Medifinder sharing the details filled by you in the membership form, including but not limited to medical history and personal details, with relevant third-party service providers (hospitals, diagnostic centres, medical stores) for the sole purpose of facilitating better treatment and service delivery.
• Medifinder will not be responsible or liable for any consequences arising from incorrect or incomplete information filled by you in the membership form and subsequently passed on to service providers. This includes, but is not limited to, issues related to medical history, personal details, or any other data that impacts your treatment or service.

5. Service Timelines and Emergency Disclaimer

• Medifinder team will make reasonable efforts to provide services as soon as possible upon your request.
• Medifinder is NOT an emergency helpline. For urgent medical attention or emergencies, you MUST contact your treating doctor or a hospital directly. Medifinder's services require a lead time.
• To avail services from Medifinder, you are required to contact us at least 24 hours in advance for non-emergency assistance. Requests made with less than 24 hours' notice may not be fulfilled.

6. Membership Fee: Non-Refundable and Non-Transferable

• All membership fees paid for Medifinder subscription are strictly non-refundable. Once paid, the fee will not be returned under any circumstances, including but not limited to, cancellation of membership by the customer, non-utilization of services, or dissatisfaction with service suggestions.
• Membership and the benefits associated therewith are strictly non-transferable. The membership is solely for the individual or entity in whose name it is registered and cannot be transferred, assigned, or sold to any other person or entity.
• Refund Policy

7. Limitation of Liability and Force Majeure

• Medifinder shall not be liable for any delay, interruption, or failure in providing services that arise directly or indirectly from extraordinary conditions or events beyond our reasonable control ("Force Majeure Event").
• Force Majeure Events include, but are not limited to, natural disasters (e.g., floods, earthquakes), acts of God, war, hostilities, civil disturbance, riots, strikes, lockouts, labour disputes, accidents, fire, explosion, epidemic, pandemic, public health emergencies, bad weather conditions, law and order situations, government advisories, orders, regulations, or any other governmental actions, power failures, communication line failures, or any other cause whatsoever beyond the reasonable control of Medifinder.
• In the event of a Force Majeure Event, Medifinder's obligations shall be suspended for the duration of such event, and Medifinder shall not be liable for any loss or damage arising from such delay or failure.

8. Intellectual Property

• All content, trademarks, logos, and intellectual property rights related to Medifinder and Exmass Health Private Limited are owned by or licensed to Exmass Health Private Limited. You agree not to use, reproduce, or distribute any of Medifinder's intellectual property without our prior written consent.

9. Governing Law and Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of India.
• Any dispute or claim arising out of or in connection with these Terms, or your subscription/membership with Medifinder, shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India.

10. Severability

• If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

11. Amendments

• Medifinder reserves the right to amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website or notifying you through other appropriate means. Your continued use of Medifinder services after such amendments constitutes your acceptance of the updated Terms.
